Analysis of criminal sanctions and their possible addition to ensure compliance with environmental law
Abstract
The aim of this research project is to develop proposals and recommendations on how different measures in Germany can contribute to preventing environmental law violations through deterrence. The project is based on an interdisciplinary and partly comparative law approach: findings from law, administrative and political science and criminology are included as well as theories of deterrence developed in economics. The recommendations developed on this basis can serve as a basis for developing policy approaches and practical measures to improve enforcement for, among others, UBA, the federal government and authorities responsible for environmental enforcement and law enforcement. In addition, the project contributes to improving the data situation, among other things by updating the publication "Environmental Offences". Through an improved data situation in the area of environmental crime, enforcement deficits can be analysed, which is the basis for their elimination.
