The classification of an object as wast is highly linked to the current legal regulations on waste. Therefore the European waste legislation required the formulation of standardized national definitions of waste. Thus the terminology of waste can be differentiated between a subjective and an objective definition, depending on whether the waste status of an object arises from the subjective intention to discard the object or from general public interest. The following paper intends to explore the question in which cases either the subjective or the objective definition of waste is used and which legal consequences are linked to them. In a later section of this thesis, the examples of Austria's informal waste management system as well as contaminated properties are taken in order to demonstrate the complexity and legal consequences of classifying certain objects as waste.
